1. Subject-Matter

These general terms and conditions apply for all deliveries of works of art and graphic prints by Bunsen Goetz GalerieGbR (following: BGG) to consumer (§ 13 BGB).

2. Contractual Partner

The purchase contract comes into being with Bunsen Goetz GalerieGbR

3. Offer and ConclusionofContract

3.1 The representation of products in our online shop does not constitute a binding offer, but rather an invitation to place an order. Errors excepted.

3.2 By clicking the buy-button, you are placing a binding order for the items listed on the order page. The contract of sale shall become effective when we accept your order by sending an order confirmation.


4. Revocation

4.1. Revocation instruction

4.1.1 Consumers have a 14-day right of revocation.

4.1.2 You may revoke your contract declaration within 14 days without giving reasons in writing (e.g. letter, email) or – if the goods are at your disposal before the end of the deadline – by return delivery.

4.1.3 The fixed period shall begin upon receipt of the goods (where similar goods are delivered on a recurring basis, then not before receipt of the last part delivery),nor before we have fulfilled our obligations to provide information as defined in Article 246 § 2 in conjunction with § 1 (1) and (2) of the Introductory Act to the Civil Code ("EGBGB") as well as our duties under § 312e (1) sentence 1 of the BGB in conjunction with Article 246 § 3 EGBGB.

4.1.4 To use your right of revocation, you haveto inform us about your decision to revoke from the contract. Revocation must be sent to:

4.1.5 The timely dispatch of the revocation or the goods shall be deemed sufficient for compliance with the revocation term.

4.2 Revocation consequences

4.2.1 In the event of a valid revocation, goods and services received by either party and derived benefits (e.g., interest), if applicable, must be returned.

4.2.2 You have to return the revoked goods immediately to BGG, but not later than within 14 days after your notice of revocation. The deadline shall be deemed to have been observed if the goods have been sent within the 14 days.

4.2.2 If you cannot return the Goods to us in whole or in part, or can return them only in degraded condition, you must pay us appropriate compensation for lost value. This shall not apply to returned goods if their deterioration is solely attributable to examining them – as you might have done in a retail store.

4.2.3 Goods consignable by parcel shipment may be returned at our risk. You must bear the expense of the return consignment if the goods delivered correspond to those ordered and if the price of the returnable goods does not exceed EUR 40,- or, if the price is higher, if you have not yet effected counterperformance or paid a contractually agreed instalment by the date of cancellation. Otherwise, the return shipment is exempt from charges.

For you, the period begins on submission of the revocation notice or return of the goods, for us upon receipt of the same.

4.3 Exclusion of the revocation

4.3.1 The right of revocation shall not apply to the delivery of goods that have been made according to customer specifications or that are clearly tailored to individual customer needs.

4.3.2 Please avoid damages or defilement.

4.3.3 Please send the goods back to us in the original packaging, as far as possible, and with all accessories and packaging elements. Use a protective packaging.Should you not have the original packaging at your disposal any more, please use appropriate packaging to protect the goods against transport damages, so as to avoid damages claims due to damage caused as a result of defective packaging.

4.3.4 Please return the goods as sufficiently stamped packages and keep the receipt of posting. If requested, we will reimburse the shipping costs in advance in as far as you are not liable to pay for them yourself.

4.3.5 Before returning the merchandise, please send an email to This email address is being protected from spambots. You need JavaScript enabled to view it., in order to announce the shipment. This way you enable us to allocate the products as quickly as possible.

4.3.6 Please note that the modalities cited in paragraphs 4.3 to 4.5 are not prerequisites for the effective exercise of the right of revocation.

5. Prices and Shipping Costs

5.1The prices stated on the product pages include the statutory value-added tax as well as other price components.

5.2 Delivery costs within Germany, within the EU and outside ofthe EU worldwide are calculated according to effort. The delivery costs shall be clearly indicated on the product site, in the shopping basket system and on the order site.


6. Delivery

6.1 The delivery times are usually up to 10 days (longer for orders being delivered outside pf Germany). If different delivery times apply to certain goods you will find out on the product pages.

6.2 Insofar as not otherwise agreed, BGG shall deliver the goods to the address specified by the buyer.


7. Liability

7.1 
On the basis of the nature of the Internet, we cannot guarantee an error-free transmission.

7.2 BGG is liable without any limitation for damages arising from a malicious or grossly negligent breach of duty on the part of BGG.

7.3 BGG is also liable for negligent breaches based on essential obligations. Essential obligations are obligations whose infringement will put the achievement of the contractual purpose at risk, or whose fulfilment is essential for the due and proper implementation of the contract, and whose fulfilment customer could reasonably rely on.
However, liability is limited to typical foreseeable damages.
BGG shall not assume liability for the negligent breach of obligations other than the ones stated in the preceding sentences.

7.4 A limitation of liability shall not apply in event of the loss of life, physical injury and damage to health, for defects after assumption of a guarantee and for maliciously concealed defects. Liability under the Product Liability Act shall remain unaffected

7.5 So far as there is a limitation of liability, same shall also apply to the personal liability of our employees, representatives and vicarious agents.


8. Payment

8.1 The payment takes place alternatively by advance payment, credit card or Paypal.

8.2 In advance payment type selection we give you our bank details in the order confirmation and deliver the item after receiving payment.

8.3 Right of termination takes effect if your counterclaims have been legally established as final and absolute or if they are beyond dispute or if they have been accepted in writing on our part.

8.4 Right of retention only exists as long as the claims result from the identical contractual relationship.


9. Retention of Title

The delivered goods stay our property until they are completely paid.


10. Minors

Our products are not offered to minors.Minors under the age of 18 may only use the services of BGG with the permission and involvement of a parent or legal guardian.
